These Terms and Conditions apply to all transactions between us and yourself. They do not affect your statutory rights. Please read them carefully.

In these Terms and Conditions, when we refer to we, us, our etc, we are referring to LEAFY. When we refer to you, we are referring to you, the customer.

By using our website and online shop, you're agreeing to these terms. If you do not accept these Terms and Conditions, then you will not be able to order any goods through our Website.

We may change these Terms and Conditions at any time with or without notice to you. Any changes will take effect on the date they are posted on our website. We shall not be liable to you or any third party for any change to these Terms and Conditions from time to time, and your continued use of this website (or any part thereof) following such change shall be deemed to be your acceptance of such change. It is your responsibility to check regularly to determine whether the Terms and Conditions have been changed.

These Terms and Conditions are governed by Scottish law and are subject to the non-exclusive jurisdiction of the Scottish courts. We do not accept amendments to these Terms and Conditions.

Failure by us to enforce any of these Terms and Conditions will not affect our right to enforce the rest of these Terms and Conditions.

All information provided about the products on this website is intended as a guide only. Dimensions and colours are approximate. Weights are approximate and stated as minimum weight in grams of the product you will receive. We will do what we reasonably can to make sure that the images are a fair representation of the products. However, we cannot guarantee that your computer's display of the colours accurately reflect the colours of the products.

We will not be responsible for any failure to perform, or delay in performance of, any of our obligations under a Contract which are caused by an Event Outside Our Control (being means any act or event beyond our reasonable control including, without limitation, strikes, lock-outs or other industrial action by third parties, civil commotion, riot, invasion, terrorist attack or threat of terrorist attack, war (whether declared or not) or threat or preparation for war, fire, explosion, storm, flood, earthquake, subsidence, epidemic or other natural disaster, or failure of public or private telecommunications networks or impossibility of the use of railways, shipping, aircraft, motor transport or other means of public or private transport). If an Event Outside Our Control takes place that affects our contract with you we will contact you as soon as reasonably possible to notify you. Please note our obligations under a contract will be suspended for the duration of the Event Outside Our Control.

Liability

We will not be liable to any user for any loss or damage, whether in contract, delict (including negligence), breach of statutory duty, or otherwise, even if foreseeable, arising under or in connection with: (i) use of, or inability to use, the website; or (ii) use of or reliance on any content displayed on the website. We will not be liable for any loss or damage caused by a virus, distributed denial-of-service attack, or other technologically harmful material that may infect your computer equipment, computer programs, data or other proprietary material due to your use of the website or to your downloading of any content on it, or on any website linked to it.

Price

The total price payable will be stipulated at the time when you place your order whether or not the order has been acknowledged. The prices on the website are in POUNDS STERLING. We are entitled to make adjustments to the price to take account of any increase in our suppliers' prices, or the imposition of any taxes or duties, or if due to an error or omission the price published for the goods is wrong whether or not the order has been acknowledged. If this happens we will inform you of the correct price and give you the opportunity to cancel the order.

All prices are inclusive of VAT but exclusive of delivery charges which, unless free delivery is offered, will be payable as indicated at the time the order is placed. Prices, offers and products are subject to availability and may change before (but not after) we accept your order. If a product becomes unavailable we may offer you an alternative. Although we endeavour to ensure that all pricing information on the website is accurate, occasionally an error may occur and goods may be mispriced. If we discover a pricing error we will, at our discretion, either: contact you and ask you whether you wish to cancel your order or continue with the order at the correct price; or notify you that we have cancelled your order. We will not be obliged to supply goods at the incorrect price. Prices that are reduced for sales and promotions are only valid for the specified period.

Payment

Payment will be taken at the time of submitting your order. Payments must be made by credit or debit card. We accept Visa, Mastercard, Switch, Solo, Delta and Visa Electron. We do not accept American Express. By submitting a credit or debit card number, you: (a) confirm that your use of the particular card is authorised and that all information that you submit is true and accurate; and (b) authorise us to charge to the card all amounts payable by you to us (including VAT and any other applicable taxes) in connection with your order.

We use the leading internet payment company STRIPE to protect your card details and protect us from fraud. The following security systems are used.

Transaction Security

You can be completely secure in the knowledge that nothing you pass to the STRIPE servers can be examined, used or modified by any third parties attempting to gain access to sensitive information.

All transaction information passed between merchant sites and STRIPE is encrypted. STRIPE uses the following protections:

• PCI Service Provider Level 1 Certification - The highest level of certification in the payments industry.

• Encrypted Data and Communication - The service uses PGP keys for safe communication.

• Money Transmitter Licenses - Stripe complies with legal regulations for payment platforms.

• HTTPS for all services using TLS (SSL)

• All card numbers are encrypted at rest with AES-256 so Stripe’s internal servers and daemons can’t obtain plaintext card numbers. STRIPE is FDIC insured.

Processing Of an Order

We will treat each order for goods as an offer by you to purchase the goods subject to these Terms and Conditions.

If we accept your order these Terms and Conditions will form the basis of the contract between us.

To order goods over the telephone or on our website, you must be at least 18 years of age and accept delivery within the UK. All telephone orders will be acknowledged verbally at the time of order, and all orders placed on our website will be acknowledged electronically by e-mail. [Please note that verbal and/or electronic acknowledgements do not constitute order confirmation or order acceptance. Your order will be accepted and the creation of a legally binding contract between you and us will take place once the goods have been dispatched or collected.

If we accept your Order, we will send you an acceptance text message or email which confirms (i) the details of the Goods, and (ii) the total order value. The Contract between us is formed when we send you the Confirmation. Alternatively, we may decline all or part of your order for any reason including availability of a product or your address being outwith our delivery area. In that case we will inform you by telephone or e-mail.

It is your responsibility to ensure that the details of your order are correct and accurate and that you provide us with all information relevant to your order. Our order process allows you to check for and amend any errors before submitting your order through the Website. You should note that we shall not be responsible for any errors which you make when inputting or submitting your order.

When deciding whether or not to accept your order we may use certain information about you, including any received from credit reference agency checks. This helps to protect you and us against fraudulent transactions.

We will tell you if your payment details cannot be authorised for any reason and may invite you to pay by another method.
